摘要

目的：明确我国药品网络销售违法违规行为的具体表现形式，从而为药品监督管理部门开展网络销售监管执法工作提供参考依据。方法：本研究系统梳理2023—2024年国家药品监督管理局官网公布的7批药品网络销售违法违规典型案例，并对案例的线索来源、违法主体类别、案由及行政处罚内容等进行深入分析。结果：通过案例解析，归纳出药品网络销售领域违法违规行为的主要表现形式及其特征。结论：本研究从法律法规完善、监管机制优化、平台责任落实以及企业自律建设等多个维度，提出具有针对性的思考与建议，以推动药品网络销售行业的规范化发展，切实保障公众用药安全。

Abstract

Objective： To clarify the specific manifestations of illegal and irregular behaviors in online pharmaceutical sales in China， thereby providing references for drug regulatory authorities to conduct supervision and law enforcement in this field. Methods： Seven batches of typical cases of illegal and irregular online pharmaceutical sales published on the official website of the National Medical Products Administration from 2023 to 2024 were sorted out. The clue sources， types of illegal entities， case causes， administration panalties in these typical cases were analyzed. Results： Through case analysis， various manifestations and related characteristics of illegal and irregular behaviors in the field of online pharmaceutical sales were identified. Conclusion： Targeted thoughts and suggestions are put forward from multiple perspectives including laws and regulations， supervision mechanisms， platform responsibilities， and enterprise self-discipline， aiming to promote the standardized and healthy development of the online pharmaceutical sales and ensure the public′s medication safety.
