Abstract: Drug Administration Law(2019) adds punitive compensation system for the first time. This article combs the legislative evolution of punitive damages in China， clarifies the legislative background and content of punitive damages in the current Drug Administration Law. Based on the particularity of drug safety， combined with the problems exposed in the judicial practice of other similar rules and regulations of food safety， this paper deeply analyzes the challenges faced by the punitive damages provisions of the current Drug Administration Law. Based on the consideration of China′s national conditions and the experience of the mature model of the United States， it is suggested that China should further standardize the elements of the system， optimize the compensation adjudication procedure， explore the practical application of public interest litigation for punitive damages for drugs， so as to improve the judicial implementation effect of the punitive damages system in the field of drug safety.
